Do You Need HOA Approval for a Patio or Pergola?
Often, yes, but it depends entirely on your HOA's documents. Many HOAs require architectural approval for permanent exterior changes, and patios and pergolas usually count. Here's how to find out and how to get approved without delays.
Where the answer lives
- Covenants (CC&Rs): the legal rules attached to your property.
- Architectural guidelines: the detailed standards the architectural review committee (ARC) uses: materials, colors, setbacks, heights.
- Bylaws and board rules: how and when applications are reviewed.
Ask your HOA manager for current copies. Don't rely on a neighbor's memory.
Projects that commonly need review
- New patios or patio expansions
- Pergolas, gazebos and other structures
- Built-in fire pits and outdoor kitchens
- Fences, retaining walls and sheds
- Major grading or tree removal
Small, movable items such as furniture or a portable fire pit often don't need approval, but some HOAs regulate those too. Check.
HOA approval is not a permit
The HOA and your city or county are separate. You may need both HOA approval and a building permit (for example, for some structures, electrical or gas work). One doesn't replace the other. For example, Forsyth County, Georgia uses its Porch/Deck/Outdoor Fireplace permit packet for pergolas and outdoor fireplaces, and a separate Residential Accessory Structure permit for detached structures such as sheds (see the county's Building Permitting page). Check your own city or county's permit office.
How to submit an application that gets approved
- Read the guidelines first and design to them.
- Include a site plan showing the project, property lines and distances to lot lines and the house.
- Add material and color details, plus photos or spec sheets.
- Include contractor information if required.
- Submit well before your contractor's start date, since review schedules vary.
- Get the approval in writing and keep it.
What if you build without approval?
Depending on your documents, the HOA may be able to require changes or removal, or apply fines. It's far cheaper to wait for approval.
